Uber Car Accident Passenger Rights

If you’ve been in a car accident caused by an Uber driver, you may be wondering whether you have any rights. Technically, the company is not responsible for the accident, but its insurance policy covers injuries, deaths, and damage from the moment a ride request is accepted. The insurance policy also includes provisions regarding the Statute of Limitations, which affects how much Uber can be sued for. This article will discuss your rights and your options for filing a lawsuit.

Uber isn’t technically responsible if a driver causes an accident

Although drivers for ride-sharing companies are required to follow certain standards, accidents caused by these vehicles do occur. The drivers are often barred from driving for Uber if they fail to maintain the vehicle properly. Unlike car insurance companies, ride-sharing companies don’t have specific engineers or quality assurance workers to inspect and maintain their cars. When drivers don’t maintain their vehicles properly, they run the risk of sudden breakdowns, brake failure, and engine trouble. Other problems may include a flat tire or broken lights.

Uber’s insurance policy covers injuries, deaths, and damage from the moment the ride request is accepted

Uber has a one million dollar insurance policy, and this will cover any injury or damage incurred in the course of a ride. The insurance policy covers injuries and damage that occurs from the time a ride request is accepted until the customer exits the vehicle. In case of an accident, the policy will cover the cost of medical expenses and property damage, and it will compensate the driver up to $1 million for each accident.

Contributory negligence rules affect how much you can sue Uber

While you may not be able to sue Uber for the negligence of another driver as a Uber car accident passenger, the company is still covered under its liability insurance policy. For example, if you were injured in a car accident while in an Uber vehicle, the company will cover your medical bills and lost wages. The amount of coverage you can recover is dependent on the extent of your injuries and the amount of damage to your property. In California, you can sue an Uber driver for a car accident if you were injured in the vehicle.

Statute of limitations
